North Dakota restaurant reaches settlement for ADA violations

MANDAN, N.D.–The US Attorney’s Office has reached a settlement with Bennigan’s Restaurant in Mandan, North Dakota in a case where an employee refused to allow a veteran with a service animal into the restaurant.
The investigation determined that the employee told the person that they were not allowed to have the dog in the restaurant without providing proper documentation. That was a violation of the American’s with Disabilities Act.
Under the agreement, Bennigan’s agreed to adopt a service animal non-discrimination policy for its restaurant, provide relevant training to its employees, post signage indicating service animals are welcome, and pay $1,000 in damages.
