PIERRE, S.D.–A bill allowing residents of a homeowners’ association (HOA) to carry weapons in any part of the HOA continued its quick trek through the South Dakota legislature Monday.
The bill would prevent an HOA board from banning firearms in the common areas of a facility, such as the sidewalk. Residents can keep guns in their homes.
It passed the House Commerce and Energy Committee 11 to 1. Previously, the measure passed the Senate 30 to 3.
Proponents said HOA’s should not be able to ban firearms, since the legislature has preempted local governments from enacting gun laws.

Proponents also said the measure would impact 40,000 South Dakotans in 17,000 HOA homes.
No one testified against the bill.
It now goes to the House of Representatives for consideration.
